Working with a Professional Real Estate Agent

Massachusetts offers several types of real estate agent representations and it is important for you to know who the Agent represents. All real estate agents must present to the Consumer, the Mass Mandatory Licensee Disclosure form at the first personal meeting with you to discuss a specific property.

(1) Seller’s Agent – who represents only the seller in a transaction;

(2) Buyer’s Agent, who represents only the Buyer in a transaction;

(3) Facilitator- (non-Agent) – who assist Buyer or Seller reach in an agreement but does not represent either in a transaction;

Dual Agent – who can represent both Buyer and Seller in a transaction, but only with prior written consent of both parties. The agent must remain neutral regarding any conflicting interest of Buyer and Seller and cannot satisfy fully the duties of loyalty, full disclosure, obedience to lawful instruction as is required by a Buyer or Seller’s agent.

Designated Seller’s and Buyer’s Agent – is an agent designated by another real estate licensee to represent a Buyer or Seller provided the Buyer or Seller agrees. The Agent now represents the Buyer or Seller as their client. No other licensees with the same firm represent the client unless otherwise agreed.
